Could an action be maintainable in a Court of Justice to enforce a right to slave property in New England or any other non slaveholding state, in a case not covered by the Constitution, or by a Treaty? The argument, ab inconvenienti, may be addressed with great force to Great Britain on this subject; but it strikes me to furnish a ground for mutual Treaty Stipulations as to slave property and the Slave trade, fit to be pressed, in negotiations, although difficult to support as a positive public right independent of Treaty.
